An overview of Brisk Pay’s regulatory status, registrations and regulated financial-service partnerships.

Brisk Pay provides payment, foreign exchange and related financial technology services within the regulatory frameworks applicable to the markets and services in which we operate.

We believe customers should be able to clearly understand which Brisk Pay entity they are dealing with, the registrations applicable to that entity, and where regulated services are provided through authorized financial-service partners.

1. Brisk Pay in Canada

As a registered Money Services Business, Brisk Pay is subject to applicable Canadian requirements relating to Anti-Money Laundering, Counter-Terrorist Financing, customer identification, record keeping, transaction monitoring and regulatory reporting.

Important FINTRAC Notice

Registration with FINTRAC confirms that Brisk Pay has satisfied the applicable legal requirements to register as a Money Services Business.

FINTRAC registration is not a banking licence, financial-services licence, certification or endorsement by FINTRAC.

Brisk Pay therefore describes its Canadian regulatory status as registered with FINTRAC, rather than licensed or authorized by FINTRAC.

2. United Kingdom Payment and Foreign Exchange Services

Where payment and foreign exchange services are provided through Brisk Pays United Kingdom operations, those services may be delivered with the support of regulated financial-service partners.

Brisk Pay Ltd, registered in England and Wales under Company Number 16262133, works with iBanFirst Limited as a payment and liquidity partner.

iBanFirst Limited is registered in England and Wales under Company Number 06260585 and is authorized by the Financial Conduct Authority (FCA) as an Electronic Money Institution under the Electronic Money Regulations 2011.

FCA Firm Reference Number: 1001629

The FCA authorization belongs to iBanFirst Limited.

Brisk Pay does not represent iBanFirst Limiteds FCA authorization as an authorization or licence held directly by Brisk Pay.

The regulatory protections and terms applying to a particular payment or foreign exchange service may depend on the entity and financial-service provider responsible for that service.

3. Our Regulatory Approach

Brisk Pay maintains policies, procedures and controls designed to support compliance with the laws and regulatory requirements applicable to its activities.

Depending on the service and jurisdiction, these may include requirements relating to:

  • Anti-Money Laundering and Counter-Terrorist Financing

  • Customer and business verification

  • Beneficial ownership

  • Sanctions and financial crime prevention

  • Transaction monitoring

  • Record keeping

  • Regulatory reporting

  • Privacy and protection of personal information

  • Operational and security controls

  • Protection and safeguarding of customer funds where applicable

Our regulatory and compliance framework may evolve as our services, jurisdictions and applicable legal requirements change.

4. Regulated Financial-Service Partners

Brisk Pay may work with banks, payment institutions, Electronic Money Institutions and other regulated or authorized financial-service providers to deliver certain products and services.

Where a third-party provider is responsible for a regulated service, that provider may be subject to its own licensing, authorization, safeguarding and regulatory requirements.

The regulatory status of a partner does not mean that Brisk Pay automatically holds the same licence or authorization.

Where appropriate, Brisk Pay identifies the relevant provider so customers can understand which entity is responsible for the particular regulated service.

5. Customer Funds and Safeguarding

The way customer funds are held and protected depends on the particular service, jurisdiction, financial institution and regulatory arrangement involved.

Where safeguarding requirements apply, Brisk Pay and/or the relevant regulated financial-service provider will maintain arrangements required under the applicable regulatory framework.

Brisk Pay does not describe all customer funds as bank deposits or imply that all funds automatically receive deposit-insurance protection.

6. Brisk Pay Is Not a Bank

Brisk Pay is not a bank.

Brisk Pay provides financial technology, payment, foreign exchange and related services directly or through appropriately regulated financial-service partners.

An account, wallet or payment facility accessed through Brisk Pay should not automatically be understood as a conventional bank account or bank deposit held directly by Brisk Pay.

Any regulatory, safeguarding or deposit protections applying to a particular service depend on the relevant legal entity, financial-service provider, account structure, jurisdiction and applicable law.
